BOOKING TERMS AND CONDITIONS
Virgin Nepal Trek & Expedition Pvt. Ltd.

These Booking Terms and Conditions (“Terms”) apply to all trekking, peak climbing, mountaineering expeditions, tours, adventure activities, cultural journeys, helicopter-supported trips, transportation arrangements, accommodation arrangements, and other travel services booked, arranged, operated, or provided by Virgin Nepal Trek & Expedition Pvt. Ltd. (“Virgin Nepal,” “Company,” “we,” “us,” or “our”).
By making a booking, paying any deposit or advance, accepting a quotation, confirming a trip by email or other official communication, or participating in any trip arranged by Virgin Nepal, the customer, traveler, trekker, climber, or participant (“Client,” “you,” or “your”) acknowledges that they have read, understood, accepted, and agreed to these Terms.
These Terms should be read together with the itinerary, quotation, invoice, booking confirmation, payment schedule, package-specific terms, and any written instructions issued by Virgin Nepal. Where a package-specific written condition expressly differs from these general Terms, the package-specific condition will apply to that particular service.
1. COMPANY AND SCOPE OF SERVICES
Virgin Nepal Trek & Expedition Pvt. Ltd. is a Nepal-based travel, trekking, expedition, and adventure tourism company providing travel arrangements and related services in Nepal and, where applicable, Tibet, Bhutan, and other destinations through appropriate local partners, suppliers, agencies, and service providers.
Our services may include, but are not limited to:

Trekking and hiking
-
High-altitude trekking
-
Peak climbing
-
Mountaineering expeditions
-
Everest Base Camp and other Himalayan journeys
-
Restricted-area trekking
-
Cultural and heritage tours
-
Helicopter-supported travel
-
Domestic and international transportation arrangements
-
Accommodation
-
Camping and trekking logistics
-
Guides, porters, climbing staff and support staff
-
Permits and government documentation
-
Sightseeing and excursions
-
Adventure and outdoor activities
-
Private and tailor-made trips
-
Group departures
-
Destination management services
Virgin Nepal may provide services directly or arrange services through airlines, hotels, transport companies, helicopter operators, guides, porters, government authorities, permit agencies, insurance providers, restaurants, local suppliers, expedition operators, and other independent third-party service providers.
2. DEFINITIONS
For the purpose of these Terms:
“Trip” means any trekking, tour, expedition, climbing program, transport arrangement, or travel service booked through Virgin Nepal.
“Client” means the person making the booking and/or any person participating in the Trip.
“Booking” means a confirmed reservation for a Trip or service.
“Deposit” means the advance amount required to confirm a booking.
“Balance” means the remaining amount payable after the deposit.
“Supplier” means any third party providing a service connected with the Trip, including airlines, hotels, vehicles, helicopter operators, guides, porters, restaurants, permit authorities, and other providers.
“Non-refundable cost” means any amount paid or committed by Virgin Nepal to a supplier, authority, airline, hotel, transport operator, guide, staff member, permit authority, or other third party that cannot be recovered or refunded.
“Force Majeure” means circumstances beyond the reasonable control of Virgin Nepal, including but not limited to natural disasters, earthquakes, landslides, floods, avalanches, extreme weather, epidemics, pandemics, political instability, civil unrest, strikes, war, border closures, government restrictions, airport closures, flight disruptions, road blockages, trail closures, fires, acts of terrorism, security incidents, or other extraordinary circumstances.
3. BOOKING AND CONTRACT FORMATION
A booking becomes confirmed only after:
-
Virgin Nepal accepts the booking;
-
the required deposit or advance payment has been received;
-
the Client has provided the required personal and travel information; and
-
Virgin Nepal has issued written booking confirmation or otherwise confirmed the booking through an official communication channel.
A quotation or provisional itinerary does not constitute a guaranteed booking until the required payment and confirmation conditions have been completed.
Virgin Nepal reserves the right to decline a booking where operational, safety, legal, permit, health, documentation, availability, or other reasonable circumstances make the booking unsuitable.
The person making the booking confirms that they have authority to provide information and make decisions on behalf of all members of their booking party where applicable.
The person making the booking is responsible for ensuring that all members of the group have access to these Terms and understand them.
4. BOOKING DEPOSIT AND PAYMENT
A deposit or advance payment is required to confirm a booking.
The required deposit amount may vary depending on:
-
Trip type;
-
destination;
-
duration;
-
season;
-
accommodation;
-
domestic or international flights;
-
permit requirements;
-
peak climbing or expedition arrangements;
-
helicopter arrangements;
-
group size;
-
supplier payment requirements; and
-
other operational factors.
The applicable deposit amount and payment schedule will be stated in the quotation, invoice, booking confirmation, or package-specific terms.
Unless otherwise agreed in writing, the remaining balance must be paid before the commencement of the Trip.
Virgin Nepal may require full payment before issuing tickets, permits, hotel confirmations, transportation arrangements, or other services.
If the Client fails to make a required payment by the due date, Virgin Nepal may:
-
suspend the booking;
-
cancel the booking;
-
release accommodation or transport reservations;
-
cancel permits or tickets;
-
charge applicable cancellation or supplier costs; and/or
-
retain amounts already paid to the extent necessary to cover non-refundable or committed expenses.
Any bank charges, payment gateway charges, currency conversion fees, intermediary bank charges, or other transaction costs may be payable by the Client unless otherwise agreed.
5. PRICES, CURRENCY AND PRICE CHANGES
Unless otherwise stated, prices are quoted in United States Dollars (USD).
Prices are based on the costs, government fees, supplier rates, taxes, transportation costs, exchange rates, permit fees, accommodation rates, and other known expenses applicable at the time of quotation.
Government authorities, airlines, hotels, transport providers, helicopter operators, permit offices, and other suppliers may change their rates or charges.
If a government authority, supplier, airline, hotel, transport provider, helicopter operator, or other third party increases its charges after the booking has been made, Virgin Nepal reserves the right to pass the additional unavoidable cost to the Client.
Additional costs may also arise because of:
-
currency exchange fluctuations;
-
changes in government fees;
-
new taxes;
-
permit fee changes;
-
airline surcharge changes;
-
fuel price increases;
-
transportation cost increases;
-
accommodation price changes;
-
route changes;
-
additional nights;
-
additional meals;
-
additional transportation;
-
additional staff requirements;
-
rescue or evacuation costs; or
-
other unavoidable operational expenses.
Virgin Nepal will make reasonable efforts to inform the Client of significant additional costs as soon as reasonably possible.
6. SERVICES INCLUDED AND EXCLUDED
The services included in a Trip are only those specifically stated in the applicable itinerary, quotation, invoice, or package description.
Unless expressly stated as included, the following may be excluded:
-
International airfare;
-
Nepal visa fees;
-
personal expenses;
-
alcoholic beverages;
-
laundry;
-
telephone and internet charges;
-
personal equipment;
-
travel insurance;
-
medical expenses;
-
emergency evacuation;
-
helicopter rescue;
-
additional accommodation;
-
additional meals;
-
additional transportation;
-
expenses caused by flight delays;
-
expenses caused by road closures;
-
expenses caused by itinerary changes;
-
expenses caused by personal illness or injury;
-
expenses caused by voluntary changes to the itinerary;
-
tips and gratuities;
-
expenses arising from missed flights or connections;
-
expenses resulting from passport or visa problems;
-
expenses resulting from loss or damage to personal belongings; and
-
any other item not specifically identified as included.
Where there is uncertainty regarding whether an expense is included, the Client should obtain written clarification from Virgin Nepal before making the booking.
7. CLIENT RESPONSIBILITIES
The Client agrees to:
-
provide accurate and complete information;
-
provide valid passport and visa information;
-
disclose relevant medical, physical, or fitness limitations where necessary for safe trip planning;
-
comply with all immigration, permit, customs, environmental, conservation, and local regulations;
-
follow reasonable instructions from guides and trekking staff;
-
behave respectfully toward local communities, staff, other travelers, and service providers;
-
take reasonable care of equipment and accommodation;
-
pay personal expenses and additional costs when applicable;
-
maintain appropriate travel insurance;
-
arrive at designated departure points on time;
-
carry required documents;
-
comply with safety instructions; and
-
accept reasonable itinerary changes required for safety, operational, legal, or environmental reasons.
The Client is responsible for checking that all information provided to Virgin Nepal is correct.
Virgin Nepal shall not be responsible for losses arising from inaccurate, incomplete, outdated, or misleading information provided by the Client.
8. PASSPORT, VISA AND IMMIGRATION REQUIREMENTS
The Client is responsible for obtaining and maintaining:
-
a valid passport;
-
appropriate Nepal visa;
-
necessary onward travel documentation;
-
required permits;
-
visas for other countries included in the Trip;
-
any required vaccination or health documentation; and
-
any other documentation required by relevant authorities.
Passport validity requirements vary by nationality and destination. Clients should confirm current requirements with the relevant embassy, immigration authority, airline, or government authority.
Virgin Nepal may provide general assistance with visa or permit information but does not guarantee visa approval or immigration clearance.
Virgin Nepal shall not be liable for costs arising from:
-
visa refusal;
-
visa expiry;
-
incorrect visa type;
-
insufficient passport validity;
-
missing documents;
-
immigration refusal;
-
airline refusal to board;
-
customs issues; or
-
failure to meet government entry requirements.
Any resulting hotel, transportation, flight, permit, cancellation, or other costs may be payable by the Client.
9. TREKKING AND RESTRICTED-AREA PERMITS
Certain areas of Nepal require special trekking permits or other government authorization.
Where applicable, Virgin Nepal will arrange the required permits as part of the agreed service.
Restricted-area trekking permits are issued subject to the rules and requirements of the Government of Nepal and relevant authorities. The Department of Immigration states that restricted-area trekking requires the appropriate permit and that trekking outside the authorized route can constitute a violation of applicable rules.
The Client must:
-
provide accurate passport information;
-
provide photographs and documents when required;
-
follow the approved itinerary and authorized route;
-
comply with permit conditions; and
-
carry or have access to required permit documentation during the Trip.
For destinations such as Upper Mustang, Upper Dolpa, Manaslu and other controlled areas, permit fees and requirements are subject to government regulations and may change without notice. Current government fee schedules should therefore be treated as subject to official revision.
Permit fees already paid to government authorities are generally non-refundable where the authority does not provide a refund.
If a Client provides incorrect passport details, changes their travel dates after permit issuance, fails to travel, or otherwise causes a permit to become unusable, any resulting additional permit or administrative cost may be payable by the Client.
Virgin Nepal is not responsible for delays, refusals, restrictions, or changes imposed by government authorities.
10. TRAVEL INSURANCE
Travel insurance is strongly required for all Clients and may be mandatory for particular Trips.
For trekking, high-altitude trekking, peak climbing, and expedition programs, the insurance policy should specifically cover the maximum altitude and activities involved in the Trip.
Where the Trip reaches approximately 4,500 metres or above, the Client should have insurance that expressly covers:
-
high-altitude trekking;
-
emergency medical treatment;
-
hospitalization;
-
emergency evacuation;
-
helicopter evacuation where medically or operationally necessary;
-
trip interruption;
-
trip cancellation;
-
baggage loss or delay;
-
personal accident; and
-
other risks appropriate to the Trip.
The Client is responsible for checking the exclusions and conditions of their insurance policy.
Virgin Nepal does not guarantee that any particular insurance policy will accept a claim.
The Client must pay any expenses that are not covered by their insurance policy.
Virgin Nepal may request evidence of suitable insurance before departure.
If a Client refuses or fails to obtain appropriate insurance where insurance is required for the Trip, Virgin Nepal may refuse participation without being responsible for resulting losses.
11. MEDICAL CONDITION, FITNESS AND ALTITUDE
Trekking, climbing and high-altitude travel involve physical exertion and inherent risks.
The Client is responsible for determining whether they are physically and medically suitable for the Trip.
Clients should consult an appropriately qualified medical professional before undertaking high-altitude or physically demanding travel where appropriate.
The Client must inform Virgin Nepal of any relevant condition, medication, allergy, dietary restriction, previous altitude problem, or physical limitation that may reasonably affect the safe operation of the Trip.
Virgin Nepal may require a Client to leave, stop, delay, reroute, descend, or discontinue a Trip if guides or staff reasonably believe that continuing may endanger the Client or others.
In high-altitude environments, symptoms can develop unexpectedly, and no itinerary can guarantee that altitude sickness or other health problems will not occur.
Any medical treatment, evacuation, additional accommodation, transportation, food, staff, helicopter, hospital, or related costs arising from illness or injury may be the responsibility of the Client and/or their insurer.
12. GUIDE AND SAFETY AUTHORITY
Virgin Nepal's guides, trekking leaders, climbing leaders, expedition leaders, or designated staff have authority to make reasonable operational and safety decisions during the Trip.
Where necessary, they may:
-
change the route;
-
change the daily schedule;
-
delay departure;
-
shorten a walking day;
-
arrange an alternative route;
-
arrange additional accommodation;
-
stop an activity;
-
require descent;
-
arrange evacuation;
-
cancel an activity;
-
alter transportation arrangements; or
-
terminate an individual's participation where reasonably necessary for safety.
Such decisions may be made because of:
-
weather;
-
altitude;
-
illness;
-
injury;
-
trail conditions;
-
road conditions;
-
avalanche risk;
-
landslide;
-
flood;
-
earthquake;
-
political conditions;
-
government instructions;
-
safety concerns;
-
aircraft availability;
-
helicopter availability;
-
local conditions; or
-
other reasonable circumstances.
Safety decisions made by authorized Virgin Nepal staff must be respected by Clients.
13. ITINERARY CHANGES
Published itineraries are planned schedules and are not absolute guarantees.
Virgin Nepal will make reasonable efforts to operate the Trip according to the published itinerary but reserves the right to change the itinerary where necessary.
Changes may be required because of:
-
weather;
-
natural disasters;
-
road or trail conditions;
-
flight operations;
-
airport conditions;
-
government restrictions;
-
permit restrictions;
-
health and safety;
-
accommodation availability;
-
transportation availability;
-
local events;
-
strikes;
-
political conditions;
-
security concerns;
-
environmental conditions;
-
group circumstances; or
-
other circumstances outside the Company's reasonable control.
Where reasonably possible, Virgin Nepal will provide a suitable alternative.
If the alternative results in additional unavoidable costs, those costs may be payable by the Client depending on the circumstances.
Virgin Nepal will not be responsible for refunding services that cannot be used because of circumstances outside its reasonable control, except to the extent a refund is actually recovered from the relevant supplier or authority.
14. DOMESTIC FLIGHTS
Domestic flights in Nepal, including flights to mountain destinations, are subject to weather and operational conditions.
Flights may be delayed, rescheduled, cancelled, diverted, or suspended because of:
-
weather;
-
poor visibility;
-
wind;
-
airport conditions;
-
aircraft availability;
-
air traffic;
-
government restrictions;
-
technical or operational issues;
-
security restrictions; or
-
other circumstances affecting aviation safety.
Flight schedules are controlled by airlines and relevant aviation authorities, not by Virgin Nepal.
Virgin Nepal will provide reasonable assistance in arranging available alternatives.
However, Virgin Nepal does not guarantee that a flight will operate according to the published schedule.
Additional expenses arising from flight delays, cancellations, missed connections, additional hotel nights, meals, vehicles, guides, or other services may be payable by the Client where such costs are not recovered from the airline or another responsible party.
15. JOMSOM AND WEATHER-DEPENDENT FLIGHTS
For itineraries involving Jomsom or other weather-sensitive mountain airports, the Client acknowledges that flight operations are particularly dependent on weather, visibility, airport conditions, aircraft availability, and operational decisions.
A delay or cancellation of a Jomsom flight does not automatically constitute a failure by Virgin Nepal to provide the contracted service.
Where a flight cannot operate, Virgin Nepal may assist with:
-
alternative flight arrangements;
-
road transportation where available and suitable;
-
helicopter arrangements where available;
-
additional accommodation;
-
itinerary modification; or
-
other reasonable alternatives.
Any additional cost not covered by the airline, insurer, or supplier may be payable by the Client.
16. HELICOPTER RESCUE AND EVACUATION
Helicopter evacuation is subject to:
-
weather;
-
visibility;
-
helicopter availability;
-
landing conditions;
-
aviation regulations;
-
government restrictions;
-
air traffic;
-
pilot judgment;
-
medical necessity;
-
altitude;
-
aircraft performance; and
-
other safety considerations.
Virgin Nepal does not guarantee that helicopter rescue will always be immediately available.
Where helicopter evacuation is required, the Client is responsible for the applicable cost unless such cost is covered and paid directly by the Client's insurance provider or another responsible party.
Virgin Nepal may assist in coordinating rescue or evacuation but does not act as an insurer.
The Client authorizes Virgin Nepal and its representatives to coordinate reasonable emergency assistance when necessary and when the Client is unable to arrange it independently.
Any advance payment made by Virgin Nepal on behalf of a Client for rescue, helicopter, medical treatment, accommodation, transportation, or related services shall be reimbursed by the Client unless otherwise agreed in writing or paid by the Client's insurer.
17. MEDICAL EMERGENCIES
In an emergency, Virgin Nepal and its staff may take reasonable steps to obtain medical assistance for a Client.
This may include:
-
contacting medical providers;
-
arranging transportation;
-
arranging helicopter evacuation;
-
arranging hospital admission;
-
contacting insurers;
-
contacting family or emergency contacts where appropriate; and
-
changing or terminating the itinerary.
Virgin Nepal does not provide medical treatment and does not guarantee the outcome of medical or rescue services provided by independent medical or aviation providers.
All medical, hospital, rescue, evacuation, transportation, accommodation, food, communication, staff, and related expenses are the responsibility of the Client unless covered by an applicable insurance policy or otherwise agreed in writing.
18. ACCOMMODATION
Virgin Nepal may use hotels, lodges, guesthouses, teahouses, camps, resorts, or other accommodation according to the Trip.
Accommodation shown in an itinerary may be changed where necessary due to:
-
availability;
-
seasonal closure;
-
weather;
-
operational requirements;
-
group requirements;
-
safety;
-
government restrictions;
-
overbooking by the supplier; or
-
circumstances beyond Virgin Nepal's control.
Where reasonably possible, Virgin Nepal will arrange accommodation of a similar standard.
Clients are responsible for personal hotel or lodge expenses, including:
-
minibar;
-
laundry;
-
telephone;
-
room service;
-
damages;
-
lost keys;
-
additional meals;
-
additional nights; and
-
other personal charges.
Damage caused by a Client may be charged directly to the Client.
19. TRANSPORTATION
Transportation may be provided by private vehicles, public transportation, domestic airlines, tourist buses, jeeps, local vehicles, helicopters, or other transportation providers.
Vehicle availability and road conditions in mountainous regions can change rapidly.
Virgin Nepal may substitute transportation where necessary.
If the Client independently changes, misses, delays, or abandons an arranged transportation service, any resulting additional cost may be charged to the Client.
20. PORTERS, GUIDES AND LOCAL STAFF
Virgin Nepal will make reasonable efforts to provide the staff described in the applicable itinerary.
Staff allocation may change due to illness, availability, government requirements, operational circumstances, or other reasonable reasons.
Clients must treat guides, porters, drivers, cooks, hotel staff, and other personnel respectfully.
Virgin Nepal may remove a Client from a Trip if the Client engages in threatening, abusive, discriminatory, violent, illegal, or seriously disruptive behavior.
In such circumstances, the Client may be responsible for all costs associated with leaving the Trip.
21. CLIENT CANCELLATION
All cancellations must be made in writing through an official Virgin Nepal communication channel.
Cancellation charges depend on:
-
the date cancellation is received;
-
the Trip type;
-
the departure date;
-
permit issuance;
-
flights;
-
hotels;
-
transportation;
-
supplier cancellation conditions;
-
staff commitments;
-
season;
-
group size; and
-
non-refundable expenses already incurred or committed.
Cancellation received sufficiently early may qualify for a partial or full refund after deduction of applicable non-refundable costs and administrative charges.
Cancellation received closer to departure may result in higher cancellation charges.
Virgin Nepal reserves the right to retain sufficient amounts to cover all non-refundable and committed costs arising from the booking.
Where a third-party supplier has its own cancellation policy, that policy may apply.
22. NON-REFUNDABLE COSTS
The following costs may be non-refundable, depending on the supplier and circumstances:
-
Government permit fees;
-
restricted-area permits;
-
national park or conservation fees;
-
domestic flight tickets;
-
international flight tickets arranged through Virgin Nepal;
-
hotel deposits;
-
lodge reservations;
-
vehicle reservations;
-
helicopter deposits;
-
expedition permits;
-
peak climbing fees;
-
equipment reservations;
-
supplier deposits;
-
advance payments to guides or staff;
-
booking and administrative charges;
-
bank and payment processing charges;
-
third-party service fees; and
-
other costs that Virgin Nepal cannot recover.
Where these costs have already been paid or committed, Virgin Nepal may deduct them from any refund.
23. NO-SHOW
If a Client fails to arrive for a scheduled Trip without prior written notice, the booking may be treated as a no-show.
No-show bookings are generally non-refundable.
Any unused accommodation, transportation, permit, flight, guide, porter, meal, or other service may be treated as forfeited.
Virgin Nepal may attempt to assist a late-arriving Client where operationally possible, but additional costs will generally be payable by the Client.
24. LATE ARRIVAL
If a Client arrives late and misses a scheduled departure, flight, vehicle, permit arrangement, accommodation check-in, or other service, Virgin Nepal will make reasonable efforts to assist where possible.
Any additional:
-
flight;
-
vehicle;
-
hotel;
-
guide;
-
porter;
-
meal;
-
permit;
-
helicopter; or
-
other operational expense
resulting from the late arrival may be payable by the Client.
25. EARLY RETURN OR VOLUNTARY ABANDONMENT
If a Client voluntarily leaves, shortens, abandons, or changes a Trip for personal reasons, including:
-
fatigue;
-
personal preference;
-
change of plans;
-
fear;
-
family reasons;
-
financial reasons;
-
illness not requiring evacuation;
-
disagreement with the itinerary; or
-
any other personal reason,
unused services are generally non-refundable.
Any additional cost for transportation, accommodation, flights, guides, porters, staff, meals, permits, or other services required to facilitate an early return shall be payable by the Client.
26. UNUSED SERVICES
No refund will normally be provided for services included in the booking but voluntarily unused by the Client.
This may include:
-
unused accommodation;
-
unused meals;
-
unused transportation;
-
unused trekking days;
-
unused guide or porter services;
-
unused permits;
-
unused flights;
-
unused sightseeing;
-
unused activities; or
-
early departure.
Where a refund is possible, it will depend on the amount actually recovered by Virgin Nepal from the relevant supplier.
27. CANCELLATION OR RESCHEDULING BY VIRGIN NEPAL
Virgin Nepal reserves the right to cancel, postpone, reschedule, modify, or terminate a Trip where reasonably necessary.
Reasons may include:
-
safety concerns;
-
insufficient operational feasibility;
-
government restrictions;
-
permit restrictions;
-
natural disasters;
-
severe weather;
-
political instability;
-
security concerns;
-
route closure;
-
supplier failure;
-
transportation disruption;
-
force majeure;
-
or other circumstances affecting the safe or practical operation of the Trip.
Where cancellation or rescheduling is within Virgin Nepal's reasonable control, the Company may offer, depending on the circumstances:
-
an alternative departure date;
-
an alternative itinerary;
-
travel credit;
-
another available trip; or
-
a refund of eligible recoverable amounts.
Virgin Nepal's obligation to refund will be limited to amounts actually refundable or recoverable after deduction of applicable non-refundable third-party costs, unless otherwise required by applicable law.
28. FORCE MAJEURE
Virgin Nepal shall not be considered in breach of contract and shall not be liable for failure, delay, alteration, suspension, or cancellation of services caused by Force Majeure circumstances.
Force Majeure may include:
-
earthquake;
-
flood;
-
landslide;
-
avalanche;
-
extreme weather;
-
cyclone;
-
fire;
-
epidemic;
-
pandemic;
-
war;
-
terrorism;
-
civil unrest;
-
strikes;
-
border closure;
-
government restrictions;
-
airport closure;
-
road closure;
-
trail closure;
-
political instability;
-
natural disaster;
-
aviation restrictions;
-
sudden regulatory changes;
-
or other circumstances beyond Virgin Nepal's reasonable control.
In such circumstances, Virgin Nepal may offer available alternatives, including:
-
rescheduling;
-
alternative routes;
-
alternative accommodation;
-
travel credit;
-
replacement services; or
-
refund of amounts actually recovered from suppliers after deduction of non-refundable expenses.
Virgin Nepal shall not be responsible for indirect or consequential losses arising from Force Majeure.
29. THIRD-PARTY SUPPLIERS
Many travel services are provided by independent third parties.
These may include:

Virgin Nepal will use reasonable care when selecting suppliers but does not control their independent operations.
Virgin Nepal is not responsible for a third party's:

delay;
-
cancellation;
-
negligence;
-
operational failure;
-
schedule change;
-
overbooking;
-
technical problem;
-
service quality issue;
-
strike;
-
bankruptcy;
-
or other failure,
except to the extent responsibility is imposed on Virgin Nepal by applicable law.
Where a supplier provides a refund, Virgin Nepal will pass on the recoverable amount to the Client after applicable deductions.
30. AIRLINE CANCELLATION AND AIRLINE RESPONSIBILITY
Where flights are operated by an airline, the airline's conditions of carriage and applicable aviation rules may apply.
Virgin Nepal does not control airline schedules, aircraft allocation, delays, cancellations, baggage handling, or operational decisions.
Clients must comply with airline check-in requirements and baggage restrictions.
Where an airline cancels or changes a flight, Virgin Nepal may assist with available alternatives, but additional expenses may be payable by the Client if not covered by the airline or insurer.
31. HELICOPTER SERVICES
Helicopter services are subject to availability and aviation safety requirements.
A helicopter reservation or quotation does not guarantee operation at a particular time where weather, aviation restrictions, aircraft availability, safety conditions, or government restrictions prevent operation.
If a Client requests a helicopter for convenience rather than medical necessity, the applicable helicopter cost shall be payable by the Client.
If a helicopter is arranged for emergency evacuation, all applicable charges shall be payable by the Client or their insurer.
32. PERSONAL BELONGINGS
Clients are responsible for their own belongings, passport, money, electronic devices, equipment, luggage, and valuables.
Virgin Nepal is not responsible for loss, theft, damage, or disappearance of personal belongings except where liability is imposed by applicable law.
Clients should use appropriate travel insurance and take reasonable precautions.
Any loss or damage caused by a Client to accommodation, transportation, equipment, or third-party property may be charged to the Client.
33. RISK AND ADVENTURE ACTIVITIES
The Client acknowledges that trekking, climbing, mountaineering, high-altitude travel, remote-area travel, road travel, domestic aviation, helicopter travel, camping, and adventure activities involve inherent risks.
Such risks may include:

falls;
-
altitude sickness;
-
hypothermia;
-
frostbite;
-
dehydration;
-
exhaustion;
-
injury;
-
illness;
-
avalanche;
-
rockfall;
-
landslide;
-
flood;
-
river crossing;
-
road accident;
-
aircraft accident;
-
helicopter accident;
-
animal encounters;
-
loss of belongings;
-
communication limitations;
-
delayed rescue; and
-
death.
The Client voluntarily accepts the inherent risks associated with the Trip, subject to rights and protections that cannot lawfully be excluded.
34. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Virgin Nepal shall not be liable for indirect, incidental, special, consequential, or economic losses arising from circumstances outside the Company's reasonable control.
Virgin Nepal's liability, where legally applicable, shall generally be limited to the amount actually paid to Virgin Nepal for the particular service giving rise to the claim, except where such limitation is prohibited by applicable law.
Nothing in these Terms is intended to exclude or limit liability for matters that cannot legally be excluded or limited under applicable Nepalese law.
Virgin Nepal shall not be liable for losses caused by:

Client negligence;

Client misconduct;
-
Client failure to follow instructions;
-
inaccurate information supplied by the Client;
-
failure to obtain appropriate insurance;
-
visa refusal;
-
passport problems;
-
missed flights caused by the Client;
-
personal itinerary changes;
-
voluntary abandonment;
-
third-party supplier failure;
-
Force Majeure; or
-
circumstances beyond the Company's reasonable control.
35. CLIENT MISCONDUCT
Virgin Nepal may immediately terminate a Client's participation if the Client:
-
behaves violently;
-
threatens staff or other travelers;
-
engages in illegal activity;
-
seriously disrupts the Trip;
-
refuses reasonable safety instructions;
-
endangers themselves or others;
-
damages property;
-
harasses staff or local people; or
-
seriously breaches these Terms.
In such circumstances, the Client may be required to leave the Trip at their own expense.
No refund will normally be provided for unused services following termination caused by Client misconduct.
36. ALCOHOL, DRUGS AND ILLEGAL ACTIVITIES
Clients must comply with Nepalese law and local regulations.
Illegal drugs, unlawful activities, violence, harassment, and dangerous behavior are strictly prohibited.
Virgin Nepal may refuse or terminate participation where a Client's conduct creates a safety or legal risk.
Any resulting costs shall be payable by the Client.
37. ENVIRONMENTAL AND LOCAL RESPONSIBILITIES
Clients must respect:

local communities;
-
religious sites;
-
monasteries;
-
cultural traditions;
-
wildlife;
-
protected areas;
-
conservation regulations;
-
waste-management rules; and
-
environmental regulations.
Clients must not remove cultural, religious, archaeological, or natural objects from protected or restricted areas.
Virgin Nepal may modify or restrict activities where necessary to comply with environmental, conservation, cultural, or government regulations.
38. PHOTOGRAPHY AND MEDIA
During a Trip, Virgin Nepal or its authorized representatives may take photographs or videos for legitimate company purposes, including:

website content;

social media;
-
promotional material;
-
brochures;
-
marketing;
-
newsletters; and
-
company publications.
Where a Client has a reasonable objection to the use of identifiable photographs or video for promotional purposes, the Client should notify Virgin Nepal in writing before or during the Trip.
Virgin Nepal will make reasonable efforts to respect such requests.
39. CHANGES REQUESTED BY THE CLIENT
After a booking has been confirmed, a Client may request changes to:

dates;

itinerary;
-
accommodation;
-
transportation;
-
group size;
-
activities;
-
route;
-
guide requirements; or
-
other services.
Changes are subject to availability and may result in additional charges.
Virgin Nepal may charge:

supplier change fees;
-
airline fees;
-
hotel fees;
-
permit reissue fees;
-
transportation fees;
-
administrative fees;
-
price differences; and
-
other unavoidable costs.
A change is not confirmed until Virgin Nepal provides written confirmation.
40. TRANSFER OF BOOKING
A Client may not transfer their booking to another person without Virgin Nepal's prior written approval.
Any transfer is subject to:

permit requirements;
-
supplier rules;
-
airline rules;
-
availability;
-
administrative requirements; and
-
applicable additional costs.
For restricted-area trekking and expedition permits, substitutions may be subject to government regulations and may not always be possible.
41. GROUP SIZE AND GROUP CHANGES
The price of a Trip may be based on a particular group size.
If the number of participants changes, Virgin Nepal reserves the right to recalculate the cost per person.
Additional costs may arise from changes to:

vehicles;
-
rooms;
-
guides;
-
porters;
-
permits;
-
flights;
-
accommodation;
-
meals;
-
equipment; or
-
other services.
The revised cost must be paid by the Client before the relevant service is provided where applicable.
42. SPECIAL REQUESTS
Virgin Nepal will make reasonable efforts to accommodate special requests such as:

dietary requirements;
-
room preferences;
-
additional beds;
-
celebration arrangements;
-
transportation preferences; or
-
other reasonable requests.
Special requests are not guaranteed unless confirmed in writing.
Any additional cost associated with a special request shall be payable by the Client.
43. COMPLAINTS DURING THE TRIP
If a Client has a problem during the Trip, the Client should immediately inform the guide, trip leader, or Virgin Nepal representative so that reasonable corrective action can be attempted while the Trip is ongoing.
Complaints raised only after completion of the Trip may be more difficult to investigate or resolve.
Written complaints should normally be submitted as soon as reasonably possible after the relevant incident.
Virgin Nepal will review legitimate complaints in good faith.
44. REFUNDS
Where a refund is approved, Virgin Nepal will calculate the refundable amount after considering:

cancellation terms;
-
supplier refunds;
-
government permit refunds;
-
airline refunds;
-
accommodation refunds;
-
transportation refunds;
-
non-refundable costs;
-
bank charges;
-
payment processing charges;
-
administrative charges; and
-
other applicable deductions.
Virgin Nepal cannot refund money that has not been recovered from a supplier or authority unless the Company voluntarily agrees otherwise.
Refund processing time depends on the payment method, bank, supplier, airline, government authority, and international banking system.
45. TRAVEL CREDIT
Where appropriate, Virgin Nepal may offer travel credit instead of a cash refund.
Travel credit:

may be subject to an expiry date;
-
may not be transferable;
-
may not be exchanged for cash;
-
may be subject to supplier restrictions; and
-
may exclude non-refundable third-party costs.
The specific conditions of any travel credit will be confirmed in writing.
46. PROMOTIONAL PRICES
Promotional, discounted, early-bird, group, last-minute, special, or customized prices may be subject to separate terms.
Unless expressly stated otherwise, promotional bookings may have stricter cancellation and refund conditions.
Promotional prices may be withdrawn or changed without prior notice before booking confirmation.
Once a booking has been confirmed, the applicable confirmed price will generally apply, subject to the price-adjustment provisions of these Terms.
47. GOVERNMENT FEES AND REGULATORY CHANGES
Government fees, permits, taxes, entry fees, conservation charges, trekking permits, and other official charges are subject to change.
Virgin Nepal cannot guarantee that government charges will remain unchanged after booking.
If an official fee increases after the booking and the additional amount is unavoidable, the Client may be required to pay the difference.
Nepal Tourism Board and the Department of Immigration publish official information regarding trekking permits and related requirements.
48. DATA AND PERSONAL INFORMATION
Virgin Nepal may collect and process Client information reasonably necessary to provide travel services.
This may include:

name;
-
passport details;
-
nationality;
-
date of birth;
-
contact information;
-
emergency contact;
-
travel dates;
-
permit information;
-
insurance information; and
-
other information required by suppliers or government authorities.
Information may be shared with relevant airlines, hotels, transport providers, permit authorities, guides, rescue providers, insurance companies, and other service providers where reasonably necessary to operate the Trip.
Virgin Nepal will take reasonable steps to protect Client information but cannot guarantee absolute security of electronic communication.
49. COMMUNICATION
Official communication may be made through:

-
WhatsApp;
-
telephone;
-
written correspondence;
-
official website;
-
other agreed communication channels.
The Client is responsible for providing a working email address and telephone/WhatsApp number and checking important travel communications.
Virgin Nepal shall not be responsible for missed information caused by incorrect or inactive contact details supplied by the Client.
50. THIRD-PARTY BOOKING CONDITIONS
Where a service is subject to the terms and conditions of a third-party provider, those terms may also apply.
Examples include:

airline conditions of carriage;
-
hotel policies;
-
helicopter operator conditions;
-
government permit rules;
-
national park regulations;
-
insurance policy conditions;
-
transportation provider rules; and
-
expedition or climbing permit conditions.
In case of conflict, mandatory government regulations and applicable third-party contractual conditions may govern the relevant service.
51. NO GUARANTEE OF WEATHER OR NATURAL CONDITIONS
Virgin Nepal does not guarantee:

clear weather;
-
mountain visibility;
-
successful summit attempts;
-
flight operation;
-
specific trail conditions;
-
absence of snowfall;
-
absence of rain;
-
absence of landslides;
-
absence of altitude sickness;
-
wildlife sightings;
-
specific accommodation availability; or
-
any particular natural condition.
Mountain environments are unpredictable.
Trip schedules may therefore be changed when necessary.
52. EXPEDITIONS AND PEAK CLIMBING
Peak climbing and mountaineering expeditions involve substantially greater risks than ordinary trekking.
Summit success is never guaranteed.
Factors including weather, route conditions, altitude, physical condition, acclimatization, technical difficulty, permits, expedition logistics, guide decisions, and safety considerations may prevent a summit attempt or summit success.
No refund shall automatically be payable because a Client does not reach a summit.
Where an expedition is shortened or terminated for safety reasons, unused services may remain non-refundable to the extent that Virgin Nepal or its suppliers have already incurred the relevant costs.
53. EMERGENCY DECISION-MAKING
Where immediate action is required to protect a Client's health or safety and the Client cannot provide instructions, Virgin Nepal and its representatives may take reasonable emergency measures.
This may include arranging:

evacuation;
-
medical treatment;
-
hospital admission;
-
transportation;
-
accommodation;
-
communication with emergency contacts; or
-
itinerary termination.
The Client authorizes reasonable emergency coordination in such circumstances.
All resulting expenses remain payable by the Client unless otherwise covered by insurance or another responsible party.
54. FINANCIAL RESPONSIBILITY FOR ADDITIONAL COSTS
The Client expressly acknowledges that additional costs may arise during adventure travel.
Where an additional cost is caused by:

the Client's personal decision;
-
Client illness or injury;
-
Client's late arrival;
-
Client's voluntary itinerary change;
-
missed transportation;
-
passport or visa problems;
-
personal evacuation;
-
early departure;
-
additional accommodation;
-
additional transportation;
-
additional meals;
-
additional staff;
-
private vehicle requirements;
-
helicopter use;
-
rescue;
-
medical treatment;
-
government requirement; or
-
a non-refundable third-party charge,
such costs may be charged to the Client.
Virgin Nepal may require payment before arranging additional services where operationally possible.
55. COMPANY'S RIGHT TO RECOVER ADVANCED COSTS
If Virgin Nepal pays or advances money on behalf of a Client for any service not included in the original booking, the Client agrees to reimburse Virgin Nepal for the amount advanced.
Such expenses may include:

-
rescue;
-
hospital;
-
medical treatment;
-
hotel;
-
transportation;
-
flight;
-
permit;
-
guide;
-
porter;
-
food;
-
communication;
-
equipment;
-
government fees; or
-
other emergency or operational expenses.
Virgin Nepal may request payment immediately or before the Client's departure from Nepal where practicable.
56. NO SET-OFF
A Client may not withhold or deduct payment due to Virgin Nepal because of a separate complaint, dispute, delay, or claim unless expressly agreed in writing or required by applicable law.
All undisputed amounts must be paid according to the agreed payment schedule.
57. GOVERNING LAW
These Terms and the relationship between the Client and Virgin Nepal shall be governed by the laws of Nepal, subject to any mandatory legal rights that cannot lawfully be excluded.
58. DISPUTE RESOLUTION
Virgin Nepal encourages Clients to resolve any dispute through good-faith discussion and written communication.
Where a dispute cannot be resolved informally, the parties may seek mediation or another appropriate dispute-resolution process in Nepal before pursuing formal legal proceedings, where appropriate.
Nothing in this clause prevents either party from exercising rights that cannot legally be waived.
59. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.
The remaining provisions shall continue in full force and effect.
60. ENTIRE AGREEMENT
These Terms, together with the applicable quotation, invoice, booking confirmation, itinerary, package-specific terms, and written amendments, constitute the agreement between the Client and Virgin Nepal concerning the booked services.
Any verbal statement that materially changes the agreed terms must be confirmed in writing by an authorized representative of Virgin Nepal to be effective.
61. AMENDMENTS TO THESE TERMS
Virgin Nepal may update these Terms from time to time to reflect:

changes in law;

government regulations;
-
permit requirements;
-
supplier conditions;
-
operational practices;
-
safety requirements; or
-
business requirements.
The Terms applicable to a confirmed booking will generally be those accepted at the time of booking, unless a change is required by law, government regulation, or another mandatory requirement.
62. ACCEPTANCE OF TERMS
By making a booking, paying a deposit, confirming a Trip, or participating in a Trip arranged by Virgin Nepal Trek & Expedition Pvt. Ltd., the Client confirms that:

they have read these Terms;

they understand the nature of the Trip;

they accept the inherent risks of adventure travel;
-
they agree to comply with applicable laws and regulations;
-
they agree to follow reasonable safety instructions;
-
they understand that itineraries may change;
-
they understand that certain costs are non-refundable;

they understand that additional costs may arise;
-
they are responsible for appropriate travel insurance; and
-
they accept these Terms as applicable to their booking.
63. PACKAGE-SPECIFIC TERMS
Individual Trip pages, quotations, invoices, booking confirmations, and itineraries may contain additional terms relating specifically to that Trip.
These may include:

deposit requirements;

payment deadlines;
-
cancellation charges;
-
permit requirements;
-
insurance requirements;
-
minimum group size;
-
altitude restrictions;
-
flight conditions;
-
accommodation arrangements;
-
equipment requirements;
-
guide requirements;

-
special government regulations; and
-
other operational conditions.
Where a package-specific written term expressly differs from these general Terms, the package-specific term shall apply to that particular Trip.
64. IMPORTANT NOTICE TO CLIENTS
Adventure travel in Nepal is different from ordinary city or resort travel.
Mountain weather, remote geography, limited infrastructure, transportation disruptions, altitude, natural disasters, and government regulations can affect travel plans with little or no advance notice.
Clients should therefore allow sufficient flexibility in their travel schedule and should not arrange important international connections immediately after a mountain trek without allowing an appropriate buffer.
Virgin Nepal strongly recommends allowing additional days in Kathmandu or another accessible location before an important international departure.

Once a booking is confirmed, Virgin Nepal may immediately incur costs and contractual commitments that may be partially or entirely non-refundable.
Accordingly, a refund is not automatically equal to the amount paid by the Client.
Any refund will be calculated after deducting applicable:

cancellation charges;
-
non-refundable deposits;
-
government permit fees;
-
visa-related charges;
-
domestic or international flight charges;
-
hotel and lodge cancellation charges;
-
transportation charges;
-
helicopter charges;
-
guide and porter commitments;
-
expedition and climbing costs;
-
supplier deposits;
-
administrative costs;
-
bank and payment processing charges;
-
third-party cancellation charges; and
-
any other costs already incurred or contractually committed by Virgin Nepal.
Virgin Nepal shall not be required to refund an amount that has already been paid to or committed to a third party and cannot reasonably be recovered.
2. Cancellation Must Be Made in Writing
All Client cancellations must be submitted in writing.
Cancellation may be submitted through:

official Virgin Nepal email;
-
official written communication channel; or
-
another communication method expressly accepted by Virgin Nepal.
A verbal cancellation, telephone conversation, message to an individual guide, driver, porter, hotel employee, or other third party will not automatically constitute formal cancellation unless acknowledged by Virgin Nepal in writing.
The cancellation date will be the date on which Virgin Nepal receives the written cancellation during normal business hours.
If cancellation is received outside normal business hours, Virgin Nepal may treat the next business day as the effective cancellation date.
3. Standard Cancellation Schedule
Unless a different cancellation schedule is expressly stated in the Client's quotation, invoice, booking confirmation, or package-specific terms, the following standard schedule shall apply:
A. Cancellation 60 Days or More Before Departure
Where written cancellation is received 60 days or more before the scheduled Trip departure date:
-
Virgin Nepal may retain the booking deposit;
-
all non-refundable government, permit, airline, hotel, transportation, supplier, administrative, and other committed costs may be deducted;
-
the remaining recoverable balance, if any, may be refunded to the Client.
The deposit is intended to cover advance preparation, reservation commitments, administrative work, supplier deposits, permit processing, and other costs incurred in preparing the Trip.
Therefore, the deposit is generally non-refundable, unless Virgin Nepal expressly agrees otherwise in writing.
B. Cancellation 30–59 Days Before Departure
Where written cancellation is received 30 to 59 days before departure:
Virgin Nepal may retain an amount sufficient to cover:
-
the booking deposit;
-
supplier cancellation charges;
-
accommodation charges;
-
transportation charges;
-
flight charges;
-
permit-related costs;
-
guide and staff commitments;
-
administrative expenses; and
-
other non-refundable or committed costs.
Any remaining recoverable amount may be refunded.
Where supplier cancellation charges exceed the deposit already paid, the Client may be responsible for the additional amount where such cost has been incurred or contractually committed on the Client's behalf.
C. Cancellation 15–29 Days Before Departure
Where written cancellation is received 15 to 29 days before departure, cancellation charges may be substantially higher because suppliers and operational arrangements have already been confirmed.
Virgin Nepal may retain:

the deposit;
-
non-refundable permit fees;
-
flight charges;
-
hotel and lodge charges;
-
transport charges;
-
guide and porter commitments;
-
supplier cancellation fees;
-
administrative costs; and
-
other committed expenses.
Virgin Nepal may retain up to 75% of the total Trip price, where reasonably required to cover applicable cancellation and committed costs.
Any balance that remains recoverable may be refunded.
D. Cancellation 7–14 Days Before Departure
Where written cancellation is received 7 to 14 days before departure, Virgin Nepal may retain up to 90% of the total Trip price, together with any additional non-refundable third-party costs where applicable.
Because many travel services become fully committed within this period, refunds may be limited or unavailable.
Where actual non-refundable costs exceed 90% of the Trip price, Virgin Nepal may retain the additional amount where legally permissible and where the Client has expressly authorized or agreed to the relevant service expenditure.
E. Cancellation Less Than 7 Days Before Departure
Where cancellation is received less than 7 days before departure, the booking will generally be considered 100% non-refundable.
No refund will normally be provided because the majority of travel arrangements may already have been paid for, confirmed, reserved, or made unavailable for resale.
This includes cancellations caused by:

change of personal plans;
-
change of mind;
-
delayed arrival in Nepal;
-
inability to obtain leave from work;
-
missed international flights;
-
visa problems;
-
personal financial circumstances;
-
failure to prepare physically;
-
personal preference; or
-
other reasons attributable to the Client.

Important: The percentages above represent the standard contractual cancellation framework. Where actual non-refundable or committed third-party costs are higher, the Client may be responsible for those additional costs to the extent permitted by applicable law and the booking agreement.
Where actual recoverable costs are lower, Virgin Nepal may, at its reasonable discretion, provide a refund greater than the minimum stated above.
5. Deposit / Advance Payment
The booking deposit is used to secure the Trip and enable Virgin Nepal to begin making arrangements on behalf of the Client.
Depending on the Trip, the deposit may be used for permits, accommodation, domestic flights, transportation, guides, porters, staff, equipment, expedition arrangements, supplier reservations, administrative processing, and other advance commitments. Accordingly, the deposit is generally non-refundable.
Where a government authority or third-party supplier refunds part of an amount paid by Virgin Nepal, the recoverable amount may be included in the Client's refund after applicable deductions.
6. Government Permits and Fees
Government-issued permits and official fees may be non-refundable once issued or paid, including restricted-area permits, trekking permits, conservation-area fees, national park fees, climbing permits, expedition permits, TIMS-related charges, local government fees, and other official charges.
For restricted trekking routes, permits are subject to government rules and requirements. Nepal Tourism Board currently requires licensed trekking guides and agency-issued TIMS cards on specified trekking routes.
Where a permit has already been issued, paid, or committed and the relevant authority does not provide a refund, Virgin Nepal will not be responsible for refunding that amount.
7. Flight Tickets
Domestic and international flight tickets are subject to the applicable airline's fare rules. Once a ticket has been issued, cancellation or refund may be subject to airline cancellation fees, fare restrictions, no-show charges, date-change charges, taxes, service fees, and other airline conditions.
Where the airline provides a refund, Virgin Nepal will pass the recoverable amount to the Client after deduction of applicable charges. If the airline provides no refund, Virgin Nepal will not be required to refund the corresponding amount.
8. Hotel, Lodge and Accommodation Costs
Accommodation may be booked and paid for in advance. Cancellation charges imposed by hotels, lodges, guesthouses, resorts, or other accommodation providers will be deducted from any applicable refund. Where an accommodation provider retains 100% of the advance payment, Virgin Nepal may similarly retain the corresponding amount from the Client's payment.
9. Transportation and Vehicle Costs
Private vehicles, jeeps, buses, domestic transportation, and other transport services may be reserved in advance. Where a Client cancels after transportation arrangements have been confirmed, applicable cancellation or non-refundable charges may be deducted. If Virgin Nepal has already paid a driver, transport company, or supplier and the amount cannot be recovered, the Client may not be entitled to a refund of that amount.
10. Helicopter Reservation Costs
Helicopter arrangements may require advance deposits or full payment. Where a helicopter deposit or payment is non-refundable under the operator's conditions, Virgin Nepal may deduct the corresponding amount from any refund.
Emergency helicopter evacuation is treated separately and is not automatically included in the Trip price unless expressly stated. Any emergency helicopter, medical evacuation, hospital, rescue, or related cost shall be payable by the Client or their insurance provider.
11. Cancellation Due to Visa Refusal
Visa approval is the responsibility of the Client. If a visa is refused, delayed, or unavailable after the Client has booked the Trip, the normal cancellation policy will apply.
Virgin Nepal will refund only amounts recoverable after deduction of deposit, permits, flights, accommodation, transportation, supplier charges, administrative charges, and other non-refundable costs. Visa refusal does not automatically entitle the Client to a full refund.
12. Cancellation Due to Personal Illness or Injury
Personal illness or injury does not automatically entitle a Client to a full refund. Where the Client is unable to travel due to illness or injury, the normal cancellation policy applies.
Virgin Nepal strongly recommends comprehensive travel insurance that includes trip cancellation, trip interruption, medical treatment, emergency evacuation, helicopter evacuation, and other appropriate risks. Nepal Tourism Board also advises comprehensive travel insurance for trekking because emergency rescue and medical treatment can be expensive.
Where insurance covers the Client's cancellation loss, the Client should make a claim directly with their insurer. Virgin Nepal may provide reasonable documentation required for a legitimate insurance claim.
13. Cancellation Due to Family Emergency
A family emergency does not automatically cancel the Client's contractual payment obligations. Virgin Nepal may, at its discretion, consider postponement, travel credit, date change, partial refund, or other reasonable solution. Any refund will remain subject to actual non-refundable costs. Virgin Nepal may request reasonable supporting documentation before considering an exception.
14. Cancellation Due to Personal Reasons
The following are considered personal reasons and are subject to the standard cancellation policy:

change of mind;

change of travel plans;
-
work commitments;
-
family commitments;
-
financial difficulties;
-
relationship changes;
-
personal scheduling conflicts;
-
lack of preparation;
-
fear of travelling;
-
failure to obtain leave;
-
missed flights;
-
visa problems;
-
passport problems;
-
failure to arrive on time; or
-
any other reason not directly caused by Virgin Nepal.
Personal reasons do not automatically qualify for a full refund.
15. No-Show Policy
A Client who fails to arrive at the agreed meeting point, airport, hotel, or Trip departure point without prior written notice will be treated as a no-show. No-show bookings are 100% non-refundable.
Virgin Nepal may have already committed funds to flights, permits, accommodation, vehicles, guides, porters, staff, meals, equipment, and other services. The Client remains responsible for any additional costs arising from the no-show where applicable.
16. Late Arrival
If a Client arrives late and misses a domestic flight, vehicle, hotel check-in, permit arrangement, group departure, guide meeting, or any other scheduled service, the missed service will generally not be refundable.
Virgin Nepal may attempt to arrange an alternative where possible. Any additional cost for flights, vehicles, hotels, guides, porters, permits, meals, or other services shall be payable by the Client.
17. Cancellation After the Trip Has Started
Once a Trip has commenced, the Trip is generally 100% non-refundable if the Client voluntarily decides to leave the Trip, return early, stop trekking, change the itinerary, refuse to continue, miss scheduled activities, or abandon the Trip for personal reasons.
Unused services (accommodation, meals, transport, guide services, porter services, permits, flights, trekking days, activities) are not automatically refundable. Any additional cost caused by early departure will be payable by the Client.
18. Medical Evacuation During the Trip
If a Client requires medical evacuation or helicopter rescue, the Trip may be interrupted or terminated. No refund will automatically be provided for unused Trip services. Any recoverable amount from suppliers may be considered for refund after deduction of applicable costs.
The Client remains responsible for helicopter evacuation, medical treatment, hospital, transportation, accommodation, food, additional staff, communication, and other emergency expenses, unless covered by insurance or another responsible party.
19. Cancellation or Interruption Due to Weather
Weather conditions may affect flights, roads, trekking trails, mountain passes, helicopter operations, accommodation, transportation, and other services. Weather-related disruption does not automatically create a right to a full refund.
Virgin Nepal may modify the itinerary, postpone activities, arrange alternatives, or shorten the Trip where reasonably necessary. Where additional costs arise because of weather-related disruption, the Client may be responsible for such costs unless they are recovered from the supplier or covered by insurance.
20. Flight Delays and Cancellations
If a domestic flight is delayed or cancelled because of weather, airport conditions, aircraft availability, operational restrictions, air traffic, government instructions, technical issues, or other circumstances beyond Virgin Nepal's reasonable control, Virgin Nepal will make reasonable efforts to assist with alternative arrangements.
However, flight operation is controlled by the airline and aviation authorities; Virgin Nepal cannot guarantee a particular flight schedule, and additional accommodation, meals, alternative transportation, or helicopter arrangements may be required at the Client's expense unless recovered from the airline, supplier, or insurance provider.
21. Force Majeure Cancellation
If a Trip must be cancelled, postponed, suspended, or substantially changed because of Force Majeure (including earthquake, flood, landslide, avalanche, extreme weather, natural disaster, political instability, civil unrest, war, terrorism, epidemic, pandemic, border closure, government restriction, airport closure, road closure, trail closure, strike, security concerns, sudden regulatory changes, or other circumstances beyond Virgin Nepal's reasonable control), Virgin Nepal shall not be responsible for indirect or consequential losses.
Virgin Nepal may offer an alternative departure date, alternative itinerary, travel credit, alternative services, or refund of amounts actually recovered from suppliers. Any refund may be reduced by non-refundable costs already incurred or committed.
22. Cancellation by Virgin Nepal
Virgin Nepal may cancel a Trip before departure where necessary because of safety concerns, government restrictions, permit restrictions, natural disaster, severe weather, political instability, security concerns, supplier failure, route closure, insufficient operational feasibility, or other circumstances affecting the reasonable operation of the Trip.
Where Virgin Nepal cancels a Trip for reasons within its reasonable control, the Company will offer an appropriate remedy (alternative departure, rescheduling, alternative itinerary, travel credit, or refund of eligible amounts). Where cancellation results from Force Majeure, Section 21 will apply.
Virgin Nepal will not be liable for consequential losses such as international airfare, visa fees, travel to Nepal, pre- or post-trip hotel bookings, lost wages, missed onward travel, business losses, or other expenses outside the booked Trip.
23. Third-Party Supplier Cancellation
Where a Trip includes services provided by third parties (airlines, hotels, lodges, helicopter operators, vehicle companies, permit authorities, expedition operators, equipment suppliers), the supplier's cancellation policy may apply. If a supplier refuses a refund, Virgin Nepal will not be required to refund the corresponding amount unless required by applicable law or expressly agreed otherwise.
24. Non-Refundable Third-Party Costs
Virgin Nepal may deduct non-refundable third-party costs from any refund, including deposits, permits, tickets, accommodation, transport, helicopter deposits, staff payments, equipment, booking fees, government charges, supplier penalties, administrative charges, and other committed expenses. The fact that a service was not ultimately used does not mean that the supplier's advance payment is refundable.
25. Travel Credit Instead of Refund
Where appropriate, Virgin Nepal may offer travel credit when the Client cancels because of personal circumstances, a Trip is affected by Force Majeure, suppliers refuse refunds but allow future credit, or postponement is operationally preferable.
Travel credit may have an expiry date, be non-transferable, be non-refundable for cash, be subject to supplier conditions, exclude non-refundable government and third-party costs, and be subject to price differences for a future Trip. Exact conditions will be confirmed in writing.
26. Postponement / Date Change
Where a Client cannot travel on the original date, Virgin Nepal may, subject to availability, allow postponement rather than cancellation. A postponement is not an automatic contractual right unless expressly stated in the applicable package terms.
Postponement may involve airline change fees, permit reissue fees, accommodation changes, transportation charges, seasonal price differences, guide and staff changes, supplier charges, and administrative fees, all payable by the Client.
27. Change from Peak Season to Off-Season or Vice Versa
If a Client changes travel dates and the new date falls into a different pricing season, Virgin Nepal may recalculate the Trip price. Any price increase shall be payable by the Client. A price decrease does not automatically create a refund unless expressly agreed by Virgin Nepal.
28. Group Booking Cancellation
For group bookings, cancellation by one or more members may affect vehicle requirements, accommodation, guide and porter requirements, permits, flights, and per-person operating costs. Virgin Nepal reserves the right to recalculate the price for remaining group members if the group size changes materially.
29. Private Trips
Private and tailor-made trips may involve higher advance commitments because services are arranged specifically for the Client. Accordingly, private trips may have stricter cancellation conditions than standard group departures, and applicable non-refundable costs may be deducted from any refund regardless of the number of days remaining before departure.
30. Peak Climbing and Expedition Cancellations
Peak climbing and expedition bookings involve substantial advance payments for permits, climbing staff, expedition equipment, base camp logistics, accommodation, transportation, domestic flights, food, porters, support staff, communication, and other expedition arrangements that may become non-refundable well before departure.
Where separate package-specific terms are provided in the quotation or booking confirmation, they shall prevail over the standard cancellation schedule.
31. Summit Failure
Failure to reach a summit does not automatically qualify for a refund. Summit success can be affected by weather, route conditions, avalanche, altitude, health, acclimatization, technical difficulty, safety, government restrictions, and guide decisions. Operational costs incurred remain payable even if the summit is not reached.
32. Unused Services Following an Itinerary Change
If an itinerary is changed for safety, operational, weather, government, or other legitimate reasons, unused services may not be refundable if Virgin Nepal has already paid or committed those costs. Where a supplier provides a refund, Virgin Nepal will make the recoverable amount available to the Client after applicable deductions.
33. Refunds Where Supplier Recovery Is Possible
Virgin Nepal will make reasonable efforts to recover refundable amounts from suppliers where appropriate. However, refund processing depends on airlines, hotels, government and permit authorities, transport suppliers, helicopter operators, banks, payment gateways, and international banking procedures, and Virgin Nepal will not be responsible for third-party delays.
34. Refund Calculation
The refundable amount will generally be calculated as:

Where the calculation results in zero or a negative amount, no refund will be payable.
35. Refund Payment Method
Approved refunds will normally be made through the original payment method. Where unavailable, Virgin Nepal may request alternative banking information. Any bank charges, intermediary bank charges, currency conversion costs, or payment gateway charges may be deducted from the refund.
36. Refund Processing Time
Approved refunds will be processed after Virgin Nepal has completed the necessary cancellation calculation and received any applicable refunds from third-party suppliers. Processing times may vary depending on external institutions.
37. Administrative and Payment Costs
Bank transfer fees, payment gateway fees, card processing fees, foreign exchange fees, intermediary bank fees, and similar charges may be non-refundable and may be deducted from the refund where legally permissible.
38. No Refund for Voluntarily Unused Services
No refund is normally payable for services that the Client voluntarily chooses not to use (skipping trekking days, refusing accommodation/meals, choosing private transport, leaving the group, declining activities, returning early, etc.).
39. Cancellation Due to Government Restriction
If government authorities restrict or prohibit travel to a destination, Virgin Nepal will make reasonable efforts to provide an alternative itinerary, alternative date, travel credit, or recoverable refund. However, amounts already paid to government authorities or suppliers may remain non-refundable.
40. Client's Responsibility to Purchase Cancellation Insurance
Clients are strongly advised to purchase travel insurance that specifically covers cancellation and interruption, appropriate for trekking, high-altitude travel, peak climbing, mountaineering, helicopter evacuation, medical treatment, and trip interruption. The Client is responsible for checking policy wording and exclusions.
41. Insurance Claims
Where a cancellation or interruption may be covered by insurance, the Client should submit the claim directly to the insurer. Virgin Nepal may provide invoices, receipts, cancellation confirmations, itineraries, or booking confirmations as supporting documents, but is not responsible for an insurer's decision.
42. No Double Recovery
The Client shall not be entitled to receive compensation twice for the same loss. Recoveries from insurers, airlines, hotels, or suppliers will be taken into account when determining any refund payable by Virgin Nepal.
43. Exceptional Circumstances
Virgin Nepal may, at its sole reasonable discretion, consider an exception to the standard cancellation policy in extraordinary circumstances (documented medical emergency, immediate family member death, major natural disaster, government travel restrictions). Any exception remains subject to actual non-refundable costs already incurred.
44. Cancellation Policy for Promotional Bookings
Discounted, promotional, early-bird, last-minute, special-offer, or fixed-departure bookings may be subject to stricter cancellation conditions (partially refundable, non-refundable, or travel-credit-only) as displayed or communicated at the time of booking.
45. Package-Specific Cancellation Terms
Specialized trips (Upper Mustang, Upper Dolpo, Manaslu, Kanchenjunga, peak climbing, mountaineering expeditions, Tibet, Bhutan, helicopter-supported programs, luxury/private tours) may carry package-specific terms stated in the quotation, invoice, or booking confirmation, which will prevail over the standard schedule.
46. No Automatic Full Refund
Payment of a Trip price does not create an unconditional right to a full refund. Refund eligibility depends on cancellation date, booking conditions, supplier conditions, permits, flights, accommodation, transportation, and services already delivered.
47. Company's Right to Deduct Amounts
Virgin Nepal may deduct from any refund all amounts reasonably attributable to cancellation, non-refundable costs, supplier penalties, government fees, administrative costs, payment costs, services already provided, and additional expenses caused by the Client.
48. Outstanding Balances
If the Client's cancellation or actions result in legitimate costs exceeding the amount already paid, Virgin Nepal may request payment of the outstanding balance where such costs arise from confirmed arrangements made on the Client's behalf and are permitted under applicable law.
49. Charge-Backs and Payment Disputes
A Client should contact Virgin Nepal directly before initiating a payment dispute or charge-back. Where an unjustified charge-back is initiated after accepting these Terms and receiving services or valid cancellation charges, Virgin Nepal reserves the right to provide relevant records to the financial institution.
50. Client Acknowledgement
By booking with Virgin Nepal Trek & Expedition Pvt. Ltd., the Client acknowledges that:
-
cancellation may result in financial loss;
-
deposits may be non-refundable;
-
government permits may be non-refundable;
-
flights may be subject to airline cancellation conditions;
-
accommodation may be subject to supplier cancellation charges;
-
helicopter bookings may be non-refundable;
-
additional costs may arise from cancellation or itinerary changes;
-
unused services are generally non-refundable;
-
no-show bookings are generally non-refundable;
-
trips that have already commenced are generally non-refundable;
-
Force Majeure may prevent a full refund;
-
travel insurance is strongly recommended;
-
the Client is responsible for understanding their insurance coverage; and
-
the applicable refund will be determined according to this Policy, the booking documents, supplier conditions, and applicable law.
51. Governing Law
This Cancellation & Refund Policy shall be governed by the applicable laws of Nepal.
Nothing in this Policy is intended to exclude or restrict any statutory right or remedy that cannot lawfully be excluded or restricted.
52. Final Provision
Virgin Nepal Trek & Expedition Pvt. Ltd. will make reasonable efforts to treat Clients fairly while protecting the Company from unrecoverable costs and commitments made on behalf of Clients.
The purpose of this Policy is to ensure transparency regarding cancellation charges, refunds, supplier commitments, and financial responsibilities before a Client confirms a booking.
By paying a deposit, confirming a booking, or participating in a Trip, the Client confirms acceptance of this Cancellation & Refund Policy.
